SC Verdict on CEC: Transparent & Accountable

A recent historic decision by the Indian Supreme Court will have a significant effect on the democracy of the nation. According to the judgement, the Chief Justice of India, the Prime Minister, and the Leader of the Opposition in the Lok Sabha must form a high-power committee to select the Chief Election Commissioner (CEC) and election commissioners (ECs). The CEC and ECs will be chosen through a transparent and accountable process based on their skills and competence rather than their political affiliations, which is a significant step forward in protecting the integrity of elections in India.

The ruling will benefit the country’s democracy by guaranteeing that the elections are held in a free and fair manner and that no political influence or manipulation has any bearing on the results. Although allegations of this nature are relatively uncommon in India, the SC ruling will provide the high-power committee with the powers that will strengthen the electoral system, increase its effectiveness, and increase its transparency. Also, it will increase public confidence in the electoral process, guaranteeing that the country’s population have faith in both the electoral system and the elected representatives.

Providing the committee with the authority to choose the CEC for a body constitutionally empowered will also raise the likelihood that more people will engage in the election process and exercise their right to vote, as well as the CEC and ECs’ accountability. They will be held responsible for their actions and decisions as a result which will then guarantee that the CEC and ECs act in the country’s and its citizens’ best interests.

According to the existing procedure, the Prime Minister receives a list of potential candidates from the Law Minister. The SC verdict indicates that the Parliament can overturn the effect of the ruling by introducing a new law on the matter, which the Government must desist from and should allow the committee to decide on for the sake of the greater good. Previously, the President made the appointment on the advice of the PM; however, now, under the ruling, the high-power committee will do it, subject to any law to be made by Parliament.

The Supreme Court of India’s decision is an important step towards advancing democracy in the nation. In addition to bolstering the electoral system, the ruling will unquestionably have a beneficial and long-lasting effect on democracy in the country. The judgement must also point to the need for choosing the head of the Enforcement Directorate (ED) and other law enforcement agencies through a similar process, as has been suggested by the Congress party. There is nothing wrong in trying to explore such possibilities because that will again guarantee that the individuals chosen will be chosen based on their qualifications and expertise rather than their political affiliations, which is essential. SC deserves to be commended for the historical judgement though!
