Amshipora ‘Staged’ Encounter & Army Court’s Recommendations!

The way the Amshipora encounter inquiry was conducted highlights the urgent need for a transparent and impartial investigation into two additional encounters, the Hyderpora encounter from November 2021 and the Lawaypora encounter from December 2020, both of which are already dogged by numerous questions even as the inquiry ordered into the Hyderpora encounter is yet to file its report.

One of the best-trained armies in the world, the Indian Army has always upheld a model of discipline. Another example of similar discipline is the life sentence given to Captain Bhoopendra Singh for his role in the staged Amshipora encounter. The Army has done this by leading by example and sending a clear message that it will not tolerate any form of wrongdoing. This serves as a reminder that the Army will never use extrajudicial means to carry out justice; instead, it will always make sure that the law is followed.
Imtiyaz Ahmed, Abrar Ahmed, and Mohammed Ibrar, three men from the Rajouri district of the Jammu region, were killed in the Amshipora “encounter” in South Kashmir in July 2020 under the pretext that they were “terrorists.” However, questions were raised about the killings, prompting the army to quickly convene a court of inquiry, which found prima facie evidence that the troops had exceeded their authority under the law, AFSPA. While the higher authorities must approve the sentence for the captain who was found guilty of breaching the line, the Indian Army has made it clear that it will not hold back on punishing its men who are found guilty.

This is a significant step in the right direction and will serve as a model for other armed forces in the future, further ensuring that the Armed Forces are independent, answerable to the public, and held accountable for their personnel’s deeds. The way the Amshipora encounter inquiry was conducted highlights the urgent need for a transparent and impartial investigation into two additional encounters, the Hyderpora encounter from November 2021 and the Lawaypora encounter from December 2020, both of which are already dogged by numerous questions even as the inquiry ordered into the Hyderpora encounter is yet to file its report.

The Army’s commitment to preserving the rule of law, willingness to hold its soldiers accountable, and commitment to upholding the highest standards of justice are all demonstrated by the decision to sentence the Captain engaged in the staged encounter to life in prison. This serves as a reminder that the Armed Forces will act swiftly to punish anyone discovered to be breaching the law. A similar investigation of the Hyderpora and Lawaypora incidents is required to hold those responsible accountable and have them brought to justice if anything went wrong, taking in mind the questions that have been raised. It is important to make sure that justice is carried out in accordance with the law of the land and that the armed forces are committed to upholding justice and accountability.
