RC, Route Permit of involved mini bus cancelled for violation of MVA

RAJOURI, NOVEMBER 6: Acting on the directions of Deputy Commissioner, Abhishek Sharma and Transport Commissioner, Vishesh Paul Mahajan, the Office of the Assistant Regional Transport Officer (ARTO) Rajouri has ordered the cancellation of the Registration Certificate and Route Permit of the mini bus involved in the tragic road accident near Thandi Kassi.

The vehicle bearing Registration No JK02AM-8074 (Model 2010), registered in the name of Anil Kumar of Thandi Kassi was plying on the route in violation of the Motor Vehicles Act, 1988 and the conditions of the route permit.

Further, the vehicle, authorized to operate on the Ghambir–Palma route, was carrying 28 passengers at the time of the accident—12 more than the prescribed seating capacity—which led to the unfortunate incident causing fatalities and serious injuries.

The order, issued under Section 55(3) of the Motor Vehicles Act, 1988, observes that the vehicle was being operated in a rash and negligent manner, in clear contravention of safety norms and permit conditions, thereby endangering public safety.

The ARTO, exercising powers as the Registering Authority, stated that the continued use of the said vehicle constitutes a potential risk to the public and therefore, its registration and route permit stands cancelled with immediate effect.

The registered owner has been directed to surrender the Registration Certificate and Route Permit within seven days of the issuance of the order, failing which further legal action shall be initiated under the provisions of the Motor Vehicles Act, 1988.
