DLSA Kupwara reviews Jail conditions, Strengthens Legal Aid Services

KUPWARA, APRIL 15: Chairman, District Legal Services Authority (DLSA), Kupwara, Principal District & Sessions Judge, Manjeet Singh Manhas conducted a quarterly inspection of District Jail Kupwara to review the conditions of inmates and the functioning of legal aid mechanisms.
On arrival, the Chairman was warmly received by the Superintendent, District Jail Kupwara.

The visit was conducted in the presence of the Deputy Commissioner Kupwara, Shrikant Suse, Secretary, DLSA Kupwara (Civil Judge Senior Division), Additional Superintendent of Police Kupwara, Learned Assistant Legal Defence Counsels (LADCs), and Para Legal Volunteers (PLVs).

During the course of the visit, the Chairman interacted at length with the inmates to ascertain their grievances and to assess their access to legal aid and representation. He reviewed the status of undertrial prisoners and emphasized the need for expeditious disposal of cases, particularly in light of the directions laid down by the Hon’ble Supreme Court in Hussainara Khatoon vs. State of Bihar (1979), which underscores the right to speedy trial as a fundamental right under Article 21 of the Constitution.

The Chairman also stressed identification of eligible inmates for release under the guidelines issued in In Re: Inhuman Conditions in 1382 Prisons (2016), wherein the Hon’ble Supreme Court directed the constitution of Under Trial Review Committees (UTRCs) to periodically review cases of undertrial prisoners for their release.

While inspecting the facilities, the Chairman took stock of the quality of food being served and inspected the kitchen to ensure maintenance of proper hygiene and nutritional standards. He also reviewed the availability of medical care, sanitation, drinking water, and accommodation facilities in light of the principles laid down in Sunil Batra vs. Delhi Administration (1978), which mandates humane conditions of detention and protection of prisoners’ rights.

Special emphasis was laid on the functioning of the Prison Legal Aid Clinic, established under the NALSA (Legal Services to Prisoners) Scheme, 2023, aimed at ensuring that no inmate is deprived of legal representation due to economic or other disabilities. The Chairman reviewed the records of the clinic and interacted with LADCs and PLVs engaged under the Legal Aid Defense Counsel System (LADCS), a flagship initiative of NALSA to strengthen the criminal legal aid system.

He further highlighted the importance of spreading awareness among inmates about beneficial schemes such as the NALSA (Victim Compensation Scheme) and other welfare measures, and directed that regular legal awareness camps be conducted inside the jail premises.

During the visit, the Deputy Commissioner Kupwara also donated sports kits to the jail authorities for the use and welfare of the inmates, with an aim to promote physical well-being and recreational activities within the jail.

The Chairman issued necessary directions to the concerned authorities for prompt redressal of grievances raised by inmates and for strengthening coordination between jail authorities and the DLSA. The visit concluded with a reaffirmation of the commitment of the Legal Services Authorities to uphold the constitutional mandate of free and competent legal aid as envisaged under Section 12 of the Legal Services Authorities Act, 1987, ensuring access to justice for all.
